FORM I-751, PETITION TO REMOVE CONDITIONS ON RESIDENCE
SPOUSAL PERMANENT GREEN CARD
I-751 PROCESS
TWO-YEAR TO PERMANENT GREEN CARD
If you were granted conditional resident status through marriage to a U.S. citizen or lawful permanent resident, based upon the marriage being less than two years old at the time of approval, then you have a two-year green card, which expires on its own.
An I-751 process, Petition to Remove Conditions on Residence, is used to file for the removal of those conditions, to convert from the two-year green card to a permanent one. You must file this package within the last 90 days of the two-year green card’s life, with very few exceptions.If you are still married, then file Form I-751 jointly with your spouse through whom you obtained the temporary two-year green card.
ALEX BARAK DELIVERS SUCCESS IN THIS CATEGORY
However, you may file Form I-751 without your spouse if:
1. You entered the marriage in good faith, but your spouse subsequently died;
2. You entered the marriage in good faith, but the marriage was later terminated due to divorce or annulment;
3. You entered the marriage in good faith, but you have been battered or subject to extreme cruelty by your petitioning spouse;
4. The termination of your status and removal from the United States would result in extreme hardship.
An I-751 requires enormous documentation. If not, be prepared to spend an enormous amount of time to document your marriage. Immigration believes a good amount of marriage cases are not legitimate, and they will point to the lack of proper joint financial documentation. GOOGLE cannot be your Immigration lawyer. Even a rocket scientist will not be able to figure out what needs to be done in this category.

Most I-751 cases take well over a year. Upon filing, the I-751 receipt gives the client an immediate two year extension of their green card. Client can always go by himself/herself on an Infopass to extend his/her green card status while the I-751 case is still pending if it is getting close to two-year marker and the case is still pending.

INFORMATION YOU PROBABLY DO NOT KNOW AND IMMIGRATION WILL NEVER TELL YOU: Once you properly file the I-751 and even if it is denied on the merits, meaning your full package was reviewed and decided against you with or without an interview, you still have your green card status until a Judge in Immigration Court formally cancels or terminates it. Until then, you have a right to obtain extensions of your green card and have your driver’s license extended.
WARNINGS: Many people are trying this process without an Immigration attorney and run into big trouble, are denied and are placed into deportation. The biggest investment one can make is securing a legal future for a spouse. Why take risks?
Some pay money to a “paralegal,” thinking it is as good as hiring an experienced Immigration lawyer. What a joke that is. It is illegal for anyone to charge fees to another person to help file any Immigration filing. These persons prey upon innocent people and cause them great damage.
“I have many people coming to me every year with cases that are “all messed up” because they tried to conduct the I-751 process with a “paralegal” or by themselves. They end up wasting multiple years and extra money to undo the damage. This does not even include the mental stress and anxiety they go through.”
There is no substitute for Alex Bark’s unparalleled success in the I-751 process. His professional writing skills and 40+ years of experience are a great advantage over other lawyers.
Alex Barak has won deportation trials in Immigration Court concerning the I-751, when clients’ lives were on the line, including one great victory against all odds in March 2020, just before the Covid 19 lockdown. Read here.
